This agreement applies to walklists.com and related services.

These Terms and Conditions ("Terms") govern your use of the canvassing services provided by Scale Campaign LLC ("Scale Campaign", "we", "us", or "our"), including our walk list generation platform, mobile canvassing app, voter data services, and geocoding tools (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use our Services. If you are using our Services on behalf of a campaign or organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Services

WalkLists provides canvassing and voter outreach services including:

  • Walk List Generation: Upload voter files (CSV or Excel) to generate printable PDF walk lists with maps, voter details, and optimized canvassing routes.
  • Mobile Canvassing App: GPS-guided door-to-door canvassing with offline mode, response recording, and real-time team synchronization.
  • Voter Data Services: Targeted voter, consumer, and donor data filtered by location, demographics, party affiliation, and voting history.
  • Geocoding: Built-in address geocoding with accuracy scoring for reliable map placement.

3. Account Registration

Some features require account registration. You agree to provide accurate information and keep your account credentials secure. You are responsible for all activity under your account. Notify us immediately of any unauthorized access.

4. Voter Data Usage Restrictions

Voter registration data obtained through our Services is subject to federal and state regulations. You acknowledge and agree to the following:

  • You will use voter data only for lawful political, governmental, or electoral purposes as permitted by applicable state laws.
  • You will not use voter data for commercial solicitation or advertising unrelated to political activity.
  • You will comply with FEC guidelines when using information regarding political contributions obtained from FEC records. See FEC Advisory Opinions 1981-05, 1984-02, and 2009-19.
  • You will not redistribute, resell, or make voter data available to unauthorized third parties.

State-by-state voter file restrictions vary. Many states limit use to political or electoral purposes only and impose penalties for misuse. You are solely responsible for understanding and complying with the voter data laws in each state where you operate.

5. Acceptable Use

You agree not to:

  • Use the Services for any illegal activity or in violation of election laws.
  • Reverse engineer, decompile, or attempt to extract the source code of our software.
  • Interfere with or disrupt the Services or the servers and networks that host them.
  • Use the Services to build a competing product or service.
  • Upload malicious files, viruses, or harmful code.
  • Share account credentials or allow unauthorized users to access the platform.

6. Payment and Subscriptions

WalkLists offers pay-as-you-go and annual subscription plans. Prices are listed on our pricing page. All payments are processed through secure third-party payment processors. Scale Campaign does not store credit card or banking information. Refunds are handled on a case-by-case basis. Contact us if you have billing questions.

7. Data Ownership

You retain ownership of data you upload to WalkLists. By uploading data, you grant us a limited license to process it for the purpose of providing our Services. Results generated from paid services (walk lists, geocoded data, canvassing reports) may be used by you for any lawful purpose but may not be redistributed as a standalone data product.

8. Intellectual Property

All materials on the WalkLists website and platform, including software, design, text, and graphics, are protected by copyright and other intellectual property laws. You may not copy, reproduce, modify, or publish any materials without prior written authorization from Scale Campaign LLC.

9. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, express or implied. Scale Campaign does not warrant that the Services will be uninterrupted, error-free, or completely secure. We do not guarantee the accuracy of geocoding results, voter data, or any other output generated by the platform.

10. Limitation of Liability

To the maximum extent permitted by law, Scale Campaign shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Scale Campaign, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your violation of these Terms, your misuse of voter data, or your use of the Services.

12. Third-Party Links

Our website may contain links to third-party sites. Scale Campaign is not responsible for the content, privacy practices, or availability of any linked sites. Use of third-party sites is at your own risk.

13. Modifications to Terms

We may update these Terms at any time. Changes take effect when posted on our website. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms. We will make reasonable efforts to notify users of material changes.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Kent County, Michigan. You consent to the jurisdiction of these courts.

15. Dispute Resolution

Before initiating any legal action, you agree to contact us and attempt to resolve the dispute informally for at least 30 days before filing legal action as provided herein.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Scale Campaign regarding your use of the Services and supersede all prior agreements.
